These Terms and Conditions ("Terms") govern your access to and use of the Hemoly mobile application (the "App") and the website at hemoly.com (the "Website"), operated by Hemoly ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Nature of the Service

1.1 Educational Purpose Only

Hemoly is an educational wellness tool, NOT a medical device, diagnostic tool, or healthcare provider. The App provides general educational information about blood test results and health biomarkers. All content, including AI-generated explanations, health scores, trend analyses, insights, correlations, and recommendations, is provided strictly for educational and informational purposes only.

1.2 Not Medical Advice

NOTHING IN THIS APP CONSTITUTES MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The information provided by Hemoly:

• Does NOT replace professional medical consultation, diagnosis, or treatment
• Does NOT establish a doctor-patient relationship
• Should NOT be used as the sole basis for any medical decision
• Should NOT be used in emergency medical situations
• May contain errors, inaccuracies, or omissions

Always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or seen in this App.

1.3 AI-Generated Content

Hemoly uses artificial intelligence (AI) to scan lab reports and generate educational content. AI-generated content:

• May be inaccurate, incomplete, or misleading
• Is generated by third-party AI models (OpenAI) and may contain errors
• Should not be relied upon as a substitute for professional medical interpretation
• Does not reflect the opinions of licensed medical professionals
• May vary in quality depending on the input data and AI model performance

We make no representations or warranties regarding the accuracy, completeness, reliability, or suitability of any AI-generated content.

1.4 Lab Report Scanning

The AI-powered Health Scan feature may not accurately extract all values from your lab reports. Extracted values may contain errors due to image quality, formatting variations, or AI limitations. Always verify scanned results against your original lab report.

2. Eligibility

• You must be at least 17 years old to use the App.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.

3. User Responsibilities

By using the App, you agree to:

• Upload only your own lab reports or reports you are authorized to access
• Not upload fraudulent, falsified, or manipulated lab reports
• Not use the App for any illegal or unauthorized purpose
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not interfere with or disrupt the App's servers or networks
• Not use automated systems (bots, scrapers) to access the App
• Not share your account with others
• Consult a qualified healthcare professional before making any health decisions based on information in the App

4. Subscriptions and Payments

4.1 Free and Premium Plans

Hemoly offers a free tier with limited features and a premium subscription with expanded access. Premium subscription options include monthly and yearly plans.

4.2 Billing

• All purchases are processed through Apple's App Store.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.3 Cancellation and Refunds

• You may cancel your subscription at any time through your Apple ID account settings.
• Cancellation takes effect at the end of the current billing period.
• Refunds are handled by Apple according to their refund policies.
• We do not provide direct refunds for App Store purchases.

4.4 Price Changes

We reserve the right to change subscription prices. Price changes will be communicated in advance and will apply to the next billing cycle after the change.

5. Intellectual Property

• The App, including its design, code, graphics, logos, and content, is owned by Hemoly and protected by intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
• You retain ownership of your uploaded lab reports and personal health data.
• By uploading content, you grant us a license to process it for the purpose of providing the App's services.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.
• WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION PROVIDED BY THE APP, INCLUDING AI-GENERATED CONTENT, HEALTH SCORES, TRENDS, INSIGHTS, OR SCANNED LAB RESULTS.
• IN NO EVENT SHALL HEMOLY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
  • Your access to, use of, or inability to use the App
  • Any content obtained from the App, including AI-generated content
  • Any medical decisions made based on information in the App
  • Unauthorized access to or alteration of your data
  • Any errors or inaccuracies in scanned lab results or health data
  • Any third-party conduct or content
• OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

7. Indemnification

You agree to indemnify, defend, and hold harmless Hemoly, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any medical decisions made based on information in the App

8. Health Disclaimer

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY. DO NOT RELY ON THIS APP FOR EMERGENCY MEDICAL SITUATIONS.

The health information in this App is not intended to be a substitute for professional medical advice. Health scores, trends, insights, and AI explanations are generated algorithmically and may not reflect your actual health status. Reference ranges may vary by laboratory, age, sex, and other factors. Always consult your healthcare provider for interpretation of your lab results.

9. Account Termination

• You may delete your account at any time through the App (Profile → Delete Account).
• Upon deletion, all your data (including lab reports, biomarker results, chat history, and personal information) will be permanently removed.
• We reserve the right to suspend or terminate your account if you violate these Terms.
• We reserve the right to discontinue the App at any time with reasonable notice.

10. Third-Party Services

The App integrates with third-party services (Firebase, OpenAI, Apple HealthKit). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Istanbul, Turkey.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hemoly regarding the use of the App and supersede any prior agreements.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
